Case: Equestria vs. Flim Skim & Flam Skim
Docket Number: CC-7852-AL
Presiding Magistrate: The Honorable Justice Iron Gavel
Date: [XXX]
Charge Summary: Conspiracy to Defraud; Grand Larceny by Deception (Multiple Counts); Operating an Unlicensed Educational Institution ("Flim Flam Brothers' Friendship University"); False Advertising (Multiple Counts); Tax Evasion; Fraudulent Sale of Medical Preparations ("Miracle Curative Tonic"); Contempt of Court (x3 – Flam Skim only).
Excerpt Begins:
(Background: Flim and Flam Skim, identical unicorn stallions, stand shackled in the defendant's dock. Flam appears composed, if weary; Flim radiates palpable anxiety. Prosecutors have presented overwhelming evidence of joint operations.)
PROSECUTOR SHARP QUILL: "Your Honor, the evidence is incontrovertible. These brothers operated as a single, predatory entity. The 'Super Speedy Cider Squeezy 6000' scheme specifically targeted Sweet Apple Acres and other legitimate cider producers, utilizing deceptive practices to seize assets. The 'Friendship University' sold worthless diplomas, defrauding hundreds of bits from hopeful students. Their 'Miracle Curative Tonic' was laboratory-confirmed to be beet juice and colored water, peddled to vulnerable ponies across three provinces. They share culpability equally."
DEFENSE COUNSEL (For Flim Skim): "Your Honor, while my client acknowledges association, the mastermind behind the operational details, the financial structuring, the... persuasive presentations... was demonstrably Flam Skim. Flim often acted under direction, his role largely logistical and promotional. We move for dismissal of primary conspiracy charges against Flim Skim based on subordinate status."
DEFENSE COUNSEL (For Flam Skim): "My client maintains his plea of 'Guilty' to all charges levied against himself. Regarding his brother... (Flam Skim leans forward, whispering urgently to his counsel, who nods). Your Honor, my client wishes to address the court directly concerning Flim Skim."
JUSTICE IRON GAVEL: "The court recognizes Flam Skim. Proceed, but be brief and relevant."
FLAM SKIM: (Standing straight, voice projecting with practiced smoothness, though lacking its usual flourish) "Thank you, Your Honor. The prosecutor speaks true – we operated together. But the initiative, the intricate planning, the... creative solutions to obstacles... those burdens rested solely on my shoulders. My brother, Flim..." (He gestures dismissively towards Flim, who flinches) "...is a capable assistant, a charming front-pony, yes. But the architect? The driving force? No. He follows. He implements. The conception, the ambition, the responsibility for the larger schemes – the University, the Tonic distribution, the Las Pegasus resort takeover – those are mine. Mine alone. He lacked the vision, the guile, the... stomach... for the truly complex endeavors. Holding him equally accountable for my designs would be a miscarriage of justice. I confess freely to all. Let the record show Flim Skim was merely an employee, often an unwitting participant in the fuller scope of my activities."
(A murmur runs through the courtroom. Flim stares at his brother, eyes wide with a mixture of shock, dawning comprehension, and fear.)
PROSECUTOR SHARP QUILL: "A convenient narrative, Your Honor! A transparent attempt to shield his twin! Their partnership is documented in countless transactions, witness testimonies–"
JUSTICE IRON GAVEL: (Raising a hoof for silence) "Enough. Mr. Flam Skim, your 'confession' is noted. It is also self-serving and strains credulity. However..." (The Justice adjusts his spectacles, scrutinizing the twins. Flam meets his gaze steadily; Flim looks down, trembling slightly) "...the prosecution has failed to provide concrete evidence directly linking Flim Skim to the planning stages of the most egregious schemes beyond association and participation under his brother's clear leadership. Flam Skim's detailed admission regarding his sole culpability for conception and primary execution, while suspect, introduces reasonable doubt specifically concerning Flim Skim's intent and mastermind status for the core conspiracy charges."
FLIM SKIM: (Whispering desperately to his counsel) "But I... we... he didn't..."
JUSTICE IRON GAVEL: "Flim Skim. Based on the evidence presented specifically against you, and considering the dubious but legally admissible statement of your co-defendant assuming primary guilt for conception and leadership, the charges of Conspiracy to Defraud (Counts 1-7, 13-19), Grand Larceny by Deception (Counts 8-12), and Operating an Unlicensed Educational Institution (Count 13) are hereby DISMISSED." (Flim sags with relief, tears welling). "You remain charged with and found guilty of False Advertising (Counts related to promotional activities) and Tax Evasion (Count 26 - Subsidiary role). Given time served awaiting trial and the nature of these secondary convictions, your sentence is commuted to TIME SERVED. You are free to go, effective immediately, pending processing."
(Flim stares, stunned, as the bailiff moves to remove his shackles. Flam doesn't look at him, his face an impassive mask.)
JUSTICE IRON GAVEL: "Flam Skim. You have pled guilty to, and the evidence overwhelmingly supports conviction on, all charges: Conspiracy to Defraud (Counts 1-7, 13-19), Grand Larceny by Deception (Counts 8-12), Operating an Unlicensed Educational Institution (Count 13), False Advertising (Multiple), Tax Evasion (Count 26), Fraudulent Sale of Medical Preparations (Counts 1-7), and Contempt of Court (x3). Your deliberate deception of this court and the citizens of Equestria is profound. Your attempt to manipulate these proceedings by shielding your brother is noted, but does not mitigate the damage done."
(The Justice levels a stern gaze at Flam.)
JUSTICE IRON GAVEL: "Your actions demonstrate a calculated, pervasive disregard for honesty and the well-being of others. Rehabilitation seems... unlikely under standard probation. Therefore, it is the judgment of this court that you be remanded to the custody of the Canterlot Department of Corrections for a term of no less than ten (10) years, with eligibility for parole contingent upon successful completion of the Equestrian Intensive Rehabilitation and Labor Program (E.I.R.L.P.), including mandatory community service at a designated work site for no less than six (6) months prior to parole review. Bailiff, remove the defendant."
(Flam's shackles are secured tightly. As he is led away, he finally glances towards Flim, who is being processed for release. Flam's expression is unreadable – resignation, perhaps, or a silent, desperate plea. Flim meets his eyes for a fleeting second, a complex mix of guilt, confusion, and dawning freedom warring on his face, before Flam is ushered through the heavy doors to the holding cells. The gavel falls with a final, echoing crack.)
